On February 28, 2006, the Ministry of industry and information technology of China (hereinafter referred to as the Ministry of industry and information technology) issued the administrative measures for pollution control of electronic information products, which came into effect on March 1, 2007《 The measures for the administration of electronic information products (EIP) defines the control of lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB), polybrominated diphenyl ethers (PBDE) and other six toxic and harmful substances in electronic information products (EIP), adopts the way of directory management, and gradually promotes the prohibition or restriction of their use.
On January 6, 2016, the Ministry of industry and information technology, together with other seven departments, issued Annex 1 of the administrative measures for limiting the use of hazardous substances in electrical and electronic products (hereinafter referred to as the "administrative measures"), which replaced the "administrative measures for pollution control of electronic information products". The measures came into effect on July 1, 2016, and the "administrative measures for pollution control of electronic information products" was abolished on the same day. Compared with the administrative measures for pollution control of electronic information products, the administrative measures expand the scope of application of products and the scope of hazardous substances restricted, and improve the pipeline mode applicable to hazardous substances of products《 The "management measures" adopts the "two-step" working idea, that is, the "first step" only requires the declaration of some hazardous substance information for the products within the scope of use in the "management measures", and the "second step" requires the implementation of the limit of hazardous substances for the products that enter the "Management Catalogue of hazardous substance restriction of electrical and electronic products".
In 2019, the State Administration of market supervision and the Ministry of industry and information technology issued a number of China's RoHS management documents. As follows:
On March 12, in addition to the original marking requirements, the products in the "Management Catalogue of hazardous substances restriction for electrical and electronic products (batch)" (hereinafter referred to as "Management Catalogue") also need to meet the limit requirements
On May 16, the State Administration of market supervision and the Ministry of industry and information technology issued the implementation arrangement for the conformity assessment system for the restricted use of hazardous substances in electrical and electronic products (hereinafter referred to as the implementation arrangement)
From November 1, the products in the Management Catalogue shall be subject to conformity assessment and attached with conformity assessment marks
1、 Control content of China ROHS certification
1. Different from EU ROHS, China's RoHS clearly lists the first batch of up to standard management catalogue, with 12 categories of electrical and electronic products! In terms of controlled substances, China only controls 6 items of RoHS.
2. The European Union's RoHS supervision is mainly based on the sampling inspection in the circulation field, and China's RoHS also has. At the same time, the Municipal Bureau of supervision and the Ministry of industry and information technology are defined as the main supervision departments. In addition, China's RoHS has strengthened regulatory measures in production, forming a complete system.
3. Different from the requirements of EU ROHS enterprises applying for certification voluntarily, China's new RoHS regulations specify that enterprises must choose one of "national voluntary certification" and "self declaration". There are four certification methods for national voluntary certification. EU ROHS has no labeling requirements; China's RoHS has identification requirements, namely "management measures for the use of green product identification", which has been formally implemented on June 1, 2019.
2、 Four modes of China's ROHS certification
Mode 1: type test + supervision of applicable parts and components products and material products after certification
Mode 2: sampling test + supervision of applicable parts and components after certification
Mode 3: optimization test + supervision after certification, applicable to complete machine products and component products
Mode 4: sampling test + initial factory inspection + supervision after certification of all products within the scope of applicable rules
For general products, mode 3 can be selected, which can be exempted from Factory review. After obtaining the certificate, the validity period of the certificate is five years. CQC will conduct random sampling inspection on the products, supervise and inspect the guarantee ability of limiting the use of hazardous substances (if necessary), and implement effective tracking investigation on the certified products. If the sample inspection is unqualified, there is a 3-month rectification period. If the rectification is not carried out within the time limit, the certificate shall be suspended or revoked. The change and extension of the certificate shall be applied to CQC, and CQC shall carry out the change and extension according to the implementation rules.
